Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the MyDataKey website, applications, and services (collectively, the “Service”). MyDataKey is a product operated by Own Your Data Inc., a Delaware 501(c)(3) nonprofit corporation (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.
1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent that you have the legal capacity to enter into these Terms and that your use complies with applicable laws and regulations.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2 Accounts & Security
- You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
- You must provide accurate, current information during registration and keep it updated.
- You must promptly notify us of any suspected unauthorized access or security incident involving your account.
- We may suspend accounts that appear compromised or that violate these Terms.
3 Description of Service (Non-Custodial)
The Service provides the world’s first Personal Data Asset Origination System (PDAOS)—tools to establish verifiable, timestamped ownership records for your personal data. Learn more in our PDAOS White Paper.
Non-Custodial by Design: MyDataKey does not operate as a personal data warehouse or vault. We process limited metadata (identifiers, hashes, timestamps, lifecycle status) to support integrity and auditability—not to store your personal data. See our Trust & Transparency page for details.

- Ownership Certificates: Timestamped, verifiable records of your data sovereignty declaration
- Identity Verification: Selfie + government ID verification to establish your identity
- Opt-Out Hub: Access to 750+ data broker opt-out tools and AI training opt-outs
- Posture Declarations: Machine-readable preferences (Allow/Limit/Restrict/Block) for data usage
No Guarantee of Outcomes
The Service may facilitate signaling, notification, or workflow actions, but we do not guarantee that any third party will respond, comply, or take any action. Outcomes depend on third parties, external systems, and applicable law.
4 User Submissions & Claim Responsibility
You may provide inputs, instructions, or submissions in connection with your use of the Service (“Submissions”), including information used to originate ownership records.
- You are responsible for your Submissions and for ensuring you have the rights and lawful basis to provide them.
- You agree not to submit false, misleading, defamatory, unlawful, or infringing information.
- You agree not to use the Service to harass, intimidate, or target others.
- Ownership records generated through the Service are declarations based on the information you provide—they are not legal judgments or determinations of truth.
5 Acceptable Use
You agree not to, and not to assist others to:
- Use the Service for unlawful, harmful, deceptive, or abusive purposes
- Attempt to gain unauthorized access to any system, account, or data
- Interfere with or disrupt the Service, including through automated scraping, denial-of-service, or malware
- Reverse engineer, decompile, or attempt to discover source code except where prohibited by law
- Use the Service to create, transmit, or amplify fraudulent or misleading claims
- Misrepresent your identity, authority, or affiliations
- Upload or transmit content that infringes intellectual property or violates privacy rights
We may implement rate limits, validation thresholds, review steps, and other safeguards to protect users and the Service.
6 Fees & Pricing
As a 501(c)(3) nonprofit, we offer a generous free tier. Paid features support our mission. See our Pricing page for current plans.
- Fees, billing intervals, and renewal terms are disclosed at checkout.
- Unless otherwise stated, fees are non-refundable except where required by law.
- You are responsible for applicable taxes, duties, or governmental assessments.
- We may change pricing with 30 days’ notice to existing subscribers.
7 Third-Party Services & Links
The Service may integrate with or link to third-party services (data broker opt-out forms, AI training opt-outs, identity verification providers) that are not controlled by the Company.
Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party services, content, or availability.
8 Intellectual Property
The Service, including its software, documentation, design, PDAOS methodology, and trademarks, is owned by the Company or its licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal or personal use.
Your Ownership Records: You retain ownership of the declarations and data you provide. We claim no ownership over your personal information or ownership certificates.
Feedback: If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation, unless prohibited by law.
9 Privacy
Our collection and use of information is described in our Privacy Policy. Our trust and transparency practices are detailed at Trust & Transparency.
Key privacy commitments:
- We do not sell your personal data
- We do not use your data for advertising
- We minimize data collection and retention
- We do not share data with data brokers
10 Security & Availability
We use reasonable administrative, technical, and organizational measures designed to protect the Service and the limited metadata we process. See our Security page for details.
However, no method of transmission or storage is completely secure. The Service may be unavailable from time to time for maintenance, upgrades, or due to factors outside our control.

11 Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that any outputs, claims, or notices will achieve any particular result or be accepted by any third party.
Not Legal Advice: Nothing in the Service or these Terms constitutes legal advice. MyDataKey helps you document and declare data ownership—it does not provide legal representation. If you require legal advice, consult a qualified attorney.
12 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13 Indemnification
You agree to defend, indemnify, and hold harmless the Company and its affiliates, and their respective directors, officers, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the Service
- Your Submissions or ownership records you create
- Any claim, notice, or workflow you initiate
- Your violation of these Terms or applicable law
14 Suspension & Termination
We may suspend or terminate your access to the Service (in whole or in part) at any time if we reasonably believe you have violated these Terms, pose a security risk, or misuse the Service.
You may stop using the Service at any time. You may request deletion of your account by contacting us.
Upon termination, your license to use the Service ends. Sections that by their nature should survive termination will survive, including: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
Your Ownership Records: Your ownership certificates remain valid independently of your account status—they are timestamped declarations that exist on their own merit.
15 Governing Law & Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue there.
16 Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by updating the “Last Updated” date and, where appropriate, providing additional notice through the Service or via email.
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
